WAIVER, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

 *PLEASE READ CAREFULLY* 

WARNING: BY SIGNING THIS AGREEMENT, YOU GIVE UP THE RIGHT TO SUE FOR ANY INJURY OR DAMAGE HOWSOEVER CAUSED 

To Accessible Waters and Adventures registered non-profit organization (Corporate Access Number: 5123780388 registered under the Companies Act of Alberta) and directors, employees, representatives, volunteers, officers or agents of Accessible Waters and Adventures. 

1. I agree as a precondition to my participation to boat tours, fishing, outdoor recreational activities, eco tourism and all related activities organized by Accessible Waters and Adventures and conducted by Accessible Waters and Adventures and/or directors/employees/volunteers of Accessible Waters and Adventures, and in further consideration of Accessible Waters and Adventures allowing me to do so, to be strictly bound by the terms of this Waiver, Assumption of Risk and Indemnity Agreement (hereinafter referred to as “This Agreement”). 

1. I acknowledge that boat tours, fishing, outdoor recreational activities, eco tourism and all related activities involve a certain degree of INHERENT RISKS that may cause serious injury, possible death, loss or damage to person or property. 

1. I fully understand the risks and dangers associated with my participation in the boat tours, fishing, outdoor recreational activities, eco tourism and all related activities and ACCEPT SAME ENTIRELY AT MY OWN RISK. 

1. I hereby WAIVE ANY AND ALL CLAIMS which I may have against Accessible Waters and Adventures and directors/employees/volunteers of Accessible Waters and Adventures and RELEASE Accessible Waters and Adventures and directors/employees/volunteers of Accessible Waters and Adventures from ALL LIABILITY for injury, death, property damage or any other loss sustained by me as a result of my participation in this boat tours, fishing, outdoor recreational activities, eco tourism and all related activities, DUE TO ANY CAUSE WHATSOEVER including, without limitation, negligence on the part of Accessible Waters and Adventures and employees/volunteers of Accessible Waters and Adventures.

2. I further AGREE TO INDEMNIFY Accessible Waters and Adventures and Adventures and employees/volunteers of Accessible Waters and Adventures for any and all legal fees (on a solicitor and his own client basis) or costs which may be incurred in defending any lawsuit or claim I may bring against them.

3. I appreciate This Agreement applies whether Accessible Waters and Adventures is at fault or not and it limits the liability of directors/employees/volunteers of Accessible Waters and Adventures to the same extent as it limits the liability of Accessible Waters and Adventures even though directors/employees/volunteers of Accessible Waters and Adventures are not formal parties to This Agreement.

4. I understand that Accessible Waters and Adventures in securing execution of This Agreement by myself, is acting as agent or trustee on behalf of or for the benefit of directors/employees/volunteers of Accessible Waters and Adventures, who shall to this extent be or be deemed to be parties of This Agreement. 

 

By checking this box, I hereby allow Accessible Waters and Adventures to use any or all of the photographs taken during the tour to be used in any of their marketing, online social media, websites or in promotional work. 

 

ALL THOSE IDENTIFIED AND SIGNED BELOW HAVE READ AND UNDERSTAND THIS AGREEMENT. After careful consideration of the risk involved, and in understanding that Accessible Waters and Adventures is a non-profit organization, all those identified and signed below RELEASE, HOLD HARMLESS AND WAIVE ALL CLAIMS associated with this activity which they may have against Accessible Waters and Adventures, it’s directors, employees, volunteers, agents and members including a RELEASE AND INDEMNITY FOR ALL CLAIMS.
